COVID 19 and other reasons for defense to motion to continue in this case were well articulated and believable



Further trial confirmation for murder suspect Hugo Parral Aguirre today just resulted in another further trial confirmation being scheduled on August 3.

Aguirre is charged with attempted murder of HCSO Deputy Rosalie Freixas; attempted murder of Carol Fuentes;  false imprisonment of Courtney Schlapicohl and assault with a firearm on HCSO Sgt. Greg Musson

Conflict Counsel Supervising Attorney Meagan O' Connell is Aguirre's attorney. Deputy District Attorney Whitney Timm appeared on the case today for Deputy DA Stacey Eads.

Ms. O'Connell made an oral motion to continue the jury trial currently scheduled for August 17.

"Due to the COVID 19 pandemic, it is difficult to get in to see Mr. Parral Aguirre with an interpreter," said Ms. O'Connell. "I was able to work with Sgt. Corral at the jail for an in person meeting while maintaining social distancing."

"This is the first opportunity since I returned to my office and since Mr. Parral Aguirre returned to Humboldt."

Ms. O'Connell was briefly the Interim Public Defender until Public Defender Marek Reavis returned from administrative leave. Aguirre was reinstated to competency and returned from the State Hospital.

" Mr. Parral Aguirre has gone back and forth between PC 1368," said Ms. O'Connell. "He is willing to enter a time waiver to accomodate a continuance."

"Mr. Parral Aguirre has requested to go over the audio recordings with me and an interpreter," said Ms. O'Connell. "In addition, we are still conducting investigation and working with two experts. "

Ms. O'Connell said she did speak with Ms. Eads about a continuance.

Ms. Timm said  she did not see any indication that the "victims have been notified."

"We set this for early trial confirmation so counsel could determine readiness," said Judge Wilson. "This is a 2017 case. Mr. Parral Aguirre has been to the state hospital. He was reinstated to competency on June 23.

"I would be inclined to grant the motion based on recent instatement of competency but I want to give the People a chance to notify the victims," said Judge Wilson.

At first, Ms. Timm did not waive written notice but when a further trial confirmation was set, she did not require a written motion to continue.
