"After speaking to Mr. Avery last Thursday, I have to declare doubt under PC 1368."



Preliminary hearing was scheduled for convicted felon Sean Avery for this morning.

His attorney, Deputy Public Defender Adrian Kamada, told Judge Kaleb Cockrum, "After speaking to Mr. Avery last Thursday, I have to declare doubt under PC 1368."

Criminal  proceedings are suspended. Dr. Wilson was appointed.  Receipt of her report is scheduled for August 6. Next court hearing September 3.

Deputy District Attorney Trent Timm was present for the People.

Avery is charged with 9 counts; eight felonies and one misdemeanor.

Count 1 is PC 207 (a), kidnapping. Special allegation for Count 1 is intentional discharge of a firearm. Count 2 is PC 245 (a) assault with a firearm. Special allegstion for Count 2 is use of a firearm during the commission of a crime. Count 3 is PC 422, criminal threats. Count 4 is PC 246.3 (a) negligent discharge of a firearm. Count 5 is PC 20110 (a) maintenance of a booby trap/device. Count 6 and 7 are felon in possession of a firearm Count 8 is PC 31360 (a), possession of body armor. Count 9 is PC 594 (b) (2), misdemeanor vandalism.

9/3: Dr's report was "mixed." Judge Lawrence Killoran ordered Avery be committed. While he did not court order the taking of medication, he told Avery "take your meds." Deputy District Attorney Stacey Eads appeared for the People. Mr. Kamada in court for Avery, who appeared via Zoom from the jail conference room.
