Sean Avery charged with 9 counts, bail increased to $345,000




Convicted felon Sean Thomas Avery is charged with 9 counts; eight felonies and one misdemeanor.

Count 1 is PC 207 (a), kidnapping. Special allegation for Count 1 is intentional discharge of a firearm. Count 2 is PC 245 (a) assault with a firearm. Special allegstion for Count 2 is use of a firearm during the commission of a crime. Count 3 is PC 422, criminal threats. Count 4 is PC 246.3 (a) negligent discharge of a firearm. Count 5 is PC 20110 (a) maintenance of a booby trap/device. Count 6 and 7 are felon in possession of a firearm Count 8 is PC 31360 (a), possession of body armor. Count 9 is PC 594 (b) (2), misdemeanor vandalism.

After arraignment update:

Before an attorney was appointed,  while Judge Christopher Wilson was asking Avery if he consented to appear via video conferencing, Avery said, " I would like to be released on my own recognizance."

Deputy District Attorney Stacey Eads was present for the People. Deputy Public Defender David Celli accepted appointment on behalf of the office.

Time was not waived. Bail/OR was waived without prejudice. Judge Wilson said he would set bail based on Count 1 and the special allegation which carries a potential sentence of 28 years. Bail was increased tp $345,000. Judge Wilson said all other counts were "part and parcel of the same incident."

Preliminary hearing is on July 14.
Avery was arrested by the Eureka Police Department on 6/28/20. Bail at booking was $75,000. The press release has 7 counts.
