Court via Zoom with no access to the 2nd floor or court offices is creating mistakes, chaos and a mess

The two parties in a civil case connected to Maziar Eshghipour's case were listed with the criminal case number on the online calendar for June 8. That was the first mistake.

I checked with Mr. Patrik Griego yesterday and Nader Eshghipour and Rogieh Ebrahim are not part of the criminal case. That is a civil asset forfeiture case.

An Evidentiary hearing regarding the order to show cause was scheduled in the civil case before the preliminary hearing scheduled for June 10. These dates were just set last week.

The DA's office then filed a motion to continue the preliminary hearing and evidentiary hearing due to the unavailability of a witness. To complicate matters, Deputy District Attorney Tobias Hasler, the prosecutor for the case is leaving the D A.'s office.

The motion to continue the preliminary hearing was granted. Setting of preliminary hearing is on July 8.

Maziar Eshghipour has retained Mr. Patrik Griego and Mr. Greg Rael. Mr. Rael appeared in court today.

The motion to continue the hearing could not be granted because Mr. David Michael was not present.
Mr. Ben Okin stepped in and asked the June 10 date remain set so he could let Mr. Michael know and the decision to continue that hearing will be decided June 10.

Mr. David Michael represents Nader Eshghipour and Rogieh Ebrahim. Mr. Michael may have present a witness. The People only have one witness, DA investigator Martin Morris who served the search warrant.

6/9 update: Just yesterday, the date of June 10 was the next court hearing. Today, while covering other cases, this case was called. The DA's motion to continue had been calendared. Mr. Hasler restated his reasons. "One of our necessary witnesses is unavailable."

Mr. David Michael informed Judge Lawrence Killoran that the civil case had been heard yesterday in front of Judge Kelly Neel. "There is no evidence or testimony that needs to be submitted," said Mr. Michael. "This is strictly a statutory issue. The government seized money from our clients. This money is not the defendant's (Maziar Eshghipour) money. I don't even know what Investigator Miller can offer. Our motion has nothing to do with the criminal case."

The DA's motion to continue was denied by Judge Killoran.
