Jury trial for one of three cases for Brian Daniels scheduled for October



Brian Daniels has three cases pending in Humboldt Superior Court.

He was finally arraigned on the 2020 misdemeanor case this morning. Daniels was not in court since there is a 977 waiver of personal appearance on file. His attorney, Deputy Conflict Counsel R. J. Leohner, appeared on his behalf, entered not guilty pleas in the new case and time was also waived for this case
This misdemeanor case and the 2018 misdemeanor case will trail the felony case.

Trial setting was scheduled today for the 2019 felony case. Trial confirmation is scheduled for October 14; jury trial for October 26.

Charges for the 2020 case are VC23152 (a), DUI and VC23152 (b), driving with a blood alcohol concentration ("BAC") of 0.08% or higher.

Charges for the 2019 case are Count 1 and Count 2 both felonies, PC 422, threat to commit crime resulting in great bodily injury or death.  Count 3 is a misdemeanor, PC 417.4, draw or exihibit an imitation firearm.

Deputy District Attorney David Moutrie appeared in court for the People.
