Several bench warrants recalled, People still have an offer and Chai Her wants more time ?



Kidnapping suspect Chai Her had his preliminary hearing scheduled today. Based on lack of courtroom availability, time being waived and defense request to continue the hearing,  date was reset to September 29.

Her is charged with Count 1, kidnapping; the alleged victim is Jennifer Talynn Hurn. Count 2 is False imprisonment by violence; alleged victim is Hurn. Count 3 is Fleeing a pursuing peace officer's motor vehicle while driving recklessly; special allegation for Count 3 is that Her has a prior conviction of a serious or violent felony or juvenile adjudication.

The People  had previously made an offer to resolve the case if Her pleads to Count 2 and 3 as misdemeanors. At that time, the offer was only open until intervention.

Then there was the pandemic. There are no interventions being formally scheduled in court and I have no direct access to court records. It was not stated today if the offer was a new one. Her has not decided if he wants to accept and resolve his case.

Deputy Conflict Counsel Owen Tipps is Her's attorney. Deputy District Attorney Shelly Small appeared for the People.

Yet another bench warrant was recalled today.
