David Anderson still charged with human sex trafficking of a minor for jury trial


Arraignment on information for convicted human trafficker David Anderson was completed this morning.

Count One is the same charge of human trafficking. Anderson was not held to answer to Count 1 of human trafficking of a minor after preliminary hearing.

I checked with Deputy District Attorney Stacey Eads. She said it is the "same code section with more language from Penal Code section 236.1 (c) to ensure it’s clear what the criminal liability theory we believe applies based upon the evidence presented."

Not guilty pleas were entered, all special allegations were denied. Dates set on a no time waived basis.

Anderson requested an OR/bail hearing today. Judge Timothy Canning told Mr. Acosta to file a motion go calendar that hearing.

Trial confirmation is August 6; jury trial on August 17.

Ms. Eads is the prosecutor for the case. Deputy DA Steven Steward appeared for her on the case today. Mr. Michael Acosta is Anderson's attorney.

Charges for jury trial:

Count 1 is PC 236.1 (c) 2, human sex trafficking  trafficking of a minor by force or violence.  Special allegation of great bodily injury during the commission of the crime and a prior conviction for human trafficking, PC 236.1 (4) (c)

Count 2 and 3 are Rape by force/violence/duress PC 261(a) (2)

Count 4 is forcible sodomy of a minor, PC 286 (c) (2)

Count 5 Forcible oral copulation of a minor, PC 288 (a) (c) (2)

Charges for preliminary hearing were:

Count 1, human trafficking of a minor for commercial with a special allegation that Anderson was previously convicted of human trafficking in November 2014.

Count 2 is forcible rape with special allegation that the offense was committed with administering a controlled substance. Count 3 is  forcible rape with special allegation that the offense was committed with administering a controlled substance .

Count 4 is forcible sodomy with special allegation that the offense was committed with administering a controlled substance .

Count 5 is  forcible oral copulation of a minor with one special allegation that the offense was committed with administering a controlled substance.
