DA files 2nd amended complaint in Maziar Eshghipour's case; defense intends to file a demurrer

A hearing on a motion by the DA to file a second amended complaint in the Maziar Esghipour's case was granted by Judge Christopher Wilson.

The defense did not object to the amended complaint but Mr. Patrik Griego told Judge Wilson that Mr. Greg Rael, "at some point intends to file a demurrer. This is Mr. Rael's case, I am only assisting."

From Wikipedia : "A demurrer is a pleading in a lawsuit that objects to or challenges a pleading filed by an opposing party. The word demur means "to object"; a demurrer is the document that makes the objection."

Only Mr. Griego was in court today. Eshghipour has a 977 waiver of personal appearance on file and was not in court today.

Judge Wilson said that Esghipour needed to be arraigned in person. That arraignment is set for the same day as intervention, which is  scheduled for November 15. A copy of the second amended complaint was given to Mr. Griego today.

The preliminary hearing is scheduled for November 28 but Mr. Griego told me  that he expects Mr. Rael will ask for a continuance, given the second amended complaint.

The case is being prosecuted by Deputy District Attorney Tobias Hasler. Deputy DA Candance Myers appeared in court for the People.

The original complaint had 4 counts. The first amended complaint had 5 counts.


When the 2nd amended complaint charges are listed,  I will add them to the post.
