$2.65 million bail for 8 charges of alleged sexual abuse of a minor, his own teenage step daughter, filed against Chad Smith, owner of Humboldt Longboard and former owner of Surfside Burger Shack

Chad A. Smith, former owner of the Surfside Burger Shack and present owner of Humboldt Long Board was arrested on Friday at 1:40 p.m. for 8 counts of PC 288.7 (b)

He is still in custody. Bail is $2.65 million. This information is from the Humboldt County Jail.


If the DA choses, the DA's office can request no bail.

The alleged minor victim is his teenage stepdaughter.
A friend of the alleged victim and her mother told me  Smith is expected to be arraigned on Wednesday.  "The DA has been very diligent and has built a very strong case.  On the heels of the Grand Jury's findings in relation to child abuse, the mother, a local elementary teacher, has been assured that this will be prosecuted to the fullest. "

California Penal Code 288.7 PC addresses situations where an adult (someone 18 years of age or older) engages in certain sexual acts with a child less than 10 years old.
Although child molestation in general is treated as a very serious crime in California, this section addresses the most serious and most extreme instances of child sexual abuse.Sometimes called a "one strike and you're out" law, a conviction under this section triggers life in prison, even upon a first offense.

    On Monday, when the Sheriff's PIO is available, I will request a mugshot. I used these photos and the only insulting comments are from people pissed about the Bernie Bus in one photo. That should show the priority and focus of those commenters. There are 8 serious charges against a man who was allowed in many places of authority and near children. The Eureka First Baptist Church isn't complaining. I also explained why I used the first photo. These are very serious allegations and any identifying information about Chad Smith or the alleged victim will be in the complaint filed and the preliminary hearing and if there is a trial. All of that is public record. Most people get this but certain cases in this small town get a lot of anonymous complaints/trolls. I have not and will not post or respond to any abusive, insulting, threatening comments towards me, especially those from the same trolls; same patterns; the same people who use any post just to vent hatred. If these allegations are true, there maybe other victims out there. That is what should be concerning you.

    I supported Bernie, but having a bus with his logo in an article on his arrest (possibly from FaceBook?) means squat. Thank you for continuing your coverage, and never mind the less hardy among my progressive friends. His support doesn't tarnish Bernie one bit in even conservative eyes, I would propose, and it serves the purpose of reinforcing what the man looks like and who he may be to people who might need to check on their kids.

    Thank you for doing what you think is right, and exercising the common right we all value, as enshrined in the 1st Amendment.

    1. Thank you very much for your comment. You must be a journalism graduate from the days when HSU journalism students won awards for doing articles better than our local press. I ignore these comments because they do not represent all those who supported Bernie. Many of my friends did. The few negative comments are from the same group of people, mostly. You would be someone I would enjoy having coffee with. We may or may not agree on everything but it would be great to get your perspective on journalism as well as the change in politucs, economy for the last couple of decades.

      I am a product from the late 90s in Journalism at HSU, so indeed there were times when our submissions were better than the local media outlets'. That is not to say that local journalism was at an ebb. I avidly read what was available, and it was quality fare for such a small market. Despite advertising and editorial disparities, I feel the local media was, at the time, more constrained for what they won awards on by what they submitted, rather than for what they produced.

      Certainly, the Lumberjack filled many gaps on every side of the table, and gritted our teeth and spoke truth to power, even when that favored Maxxam, or PalCo, or even PG&E (mostly due to the economics of transmission, and not the ethics of generation). But for all of the awards we won, I can count many where the Arcata Eye or the Times-Standard simply did not submit their best candidates, though even in such circumstances, I will still boast we were the better (even if because we alone dared).

      It would have been a wonderful thing to share the dais with winners or runners up, locally, when the awards were far afield. For that potential, I encourage you to not only strive but goad the local outlets in competing.

      Then beat them if you can. You have my full confidence that, despite our political differences of philosophy, that you would prevail and we could have a relaxing, if warily vigilant (given your current and unfortunate circumstances) coffee, indeed.

    3. I think I have goaded the local outlets in competing. They never covered courts the way they do now; that coverage could be better. Good point about receiving awards on what is submitted. Before, it was MAXXAM and PALCO, now it is growers who are also involved in other businesses. The industry may change but greed and the players remain the same. I laugh at the so called local media bragging about awards. They are meaningless. They do selective coverage, advertising does affect who and what they cover. As this blog has grown, the pettiness of not giving credit to me, not linking me, copying what I do, does not even bother me anymore. It shows a complete lack of basic journalism ettiquette. I do this blog for the community, I dont make tons of money because both on the left and the right, people who fund want control of the media. They know I won't do their bidding. In a small town, truth is very inconvenient. Humboldt has so much to offer. But it lacks the will on behalf of most people in power and with the money, both on the left and right, to give a damn about this community. If they did, they wouldn't have an ex Chamber of Commerce crony being the GM of KIEM. They would pay their local reporters better and allow them to cover news. Both sides have failed to create jobs for anyone other than their small clique of friends. I am perceived to be on the right, I am, yet I have called out people I previously supported and businesses at my financial peril, people on the right and left. Where are those on the left doing the same? Those being exposed chose to target me because it is easy, and they are too afraid to take on the real issues and do their job, as media, as businesses, as politicians and as community leaders.

    1. Thanks for the link anon. I was going to check on his family law cases tomorrow. I don't know which ex he is referring to in this link. He had a famy law case before and I will see if this is the same one or different one.

  5. I live in Oklahoma and voted for Bernie Sanders in the primary election. I'm a conservative democrat. Wrong is wrong and the picture with the campaign vehicle in the background should associate the alleged pedafle with Mr. Sanders. Both Smith and his Ex were Bernie Supporters. In my honest opinion; Im sure when the facts come out that he will die in Prison! May God have mercy on his soul and instead of having a cow about a picture; People should pray for the victim and her family!!!!!!

  6. Like I explained above, the picture of the Bernie bus was the first picture I found without his kids, then I found the others. What Chad is allegedly charged with is not a reflection on all Bernie supporters or the Eureka First Baptist Church. I agree with you that the people freaking out about the Bernie Bus photo in the background have their priorities warped and their own issues. They should be focusing on the alleged charges and hoping no one they know could be a potential victim. In Humboldt, we have certain people willing to sacrifice the truth, ignore the issues and attack me and others for their myopic political bias and agenda. They don't screech and holler at others because getting truth swept under the rug is okay for some people rather than stand up for children, women and this community.

  7. Who cares if it's a Bernie bus? I don't give a two flying fucks who he supported nor is it a reflection of that candidate. Political leanings mean nothing when speaking of rape. Let's all try to focus on the important parts of this story and not the irrelevant.

    1. What if you anon @10 a.m. get a clue that Chad is not different from any other defendant arrested. If he is charged, if he has a court hearing, whether he is innocent or guilty will be reported as the case proceeds. This crap is called reporting. In this last month, lot of people in a small town are embarassed because information inconvenient or embarassing to them is public. Easy to misdirect anger at me, istead of dealing with your issues or realize you need to research further and understand journalism and the law.

  10. I have to say I'm a little bit surprised. I knew Chad when I looked bed there, and yea, he is a bit like a slimy used car salesman, but I never thought he'd do this. .
    I was a BACA supporter at the time as was the guy I was dating was a member of BACA. They were best friends.
    If these allegations are true, it would explain why he didn't want to "officially " get involved with BACA, b
    as that requires a background check. I'm sad for his son and the step kids.
    If he did this he should get the book thrown at him.
