Has the DA's office changed their decision about the 170.1 for Judge Neel?

 


On 6/2/26, in my live coverage of the hearing for terroristic and criminal threat suspect Daryl Jones, Senior Deputy District Attorney Roger Rees said the DA's office would file the 170.1 disqualification for Humboldt Superior Court Presiding Judge Kelly Neel that day.

It is now 6/4. There is nothing in e court about the DA filing that 170.1 There is an entry stating a hearing on that 170.1 motion has been vacated. Has the DA's office changed their decision?

E court not including what has been filed could just be what is now the usual delay in Humboldt courts, even in criminal cases. Unfortunately, relying on e court or even court minutes is no longer a guarantee of accuracy or reliance.

The 6/16 date is for setting of the mental health diversion. I have not seen Mr. Rees today to ask him because that would be the easiest.
