Convicted murderer Eric Lively filed a 2025 lawsuit against Humboldt Superior Court, Humboldt Code Enforcement Unit and the State of California. Negligent spoliation, fraudelent concealment and emotional distress are alleged in his petition.
Lively claims local attorney Brad Floyd failed to garner insurance" and withheld insurance money; Lively accuses Humboldt County of "concealing the fact that Shelter Cove Fire Department criminally engaged in both of the alleged arsons."
Lively is pro per. He is in Valley State Prison according to CDCR.
E court lists the Humboldt County District Attorney and Humboldt County Counsel as attorneys. Humboldt Superior Court Presiding Judge Kelly Neel and Humboldt Superior Court Assistant Presiding Judge Timothy Canning are the only two judicial officers listed in e court.
LThe first CMC was on 12/15/25. Only Lively was present. There was no proof of summons. Lively said his name was misspelled. The clerk corrected and updated the system.
Lively provided an update on related federal filing and requested a continuance which was granted by Judge Neel. Today was the second CMC. I did not see any Case Management Statements.

Lively's complaint is "difficult to follow" is also the opinion of U.S. District Judge James Donato.
