Former Miss Hoopa seeks dismissal of sex offense case and to expunge her record, both Judge and DA say she is ineligible

 


On February 11 2019, former Miss Hoopa Kayla Brown pleaded guilty to sexual penetration of a minor under 16 years old and contact with a minor for sexual offense.  The alleged victim was a female minor. Brown had to register as a sex offender.

In April 2021, an AB 1950 order was granted. AB 1950 shortens the length of probation. Today, Brown  was in court with her mother and another family member since the defense filed a petition to dismiss and expunge her record per PC 1203.4.

Deputy District Attorney Trent Timm appeared on the case for the People. Deputy Public Defender Casey Russo appeared on the case for Deputy Public Defender Ben McLaughlin. 

Mr. Timm said that Brown was not eligible since she was convicted of PC 289. Retired Judge Christopher Wilson agreed with Mr. Timm "reading of the law."  The hearing was continued until August 2  for attorneys to evaluate eligibility and present arguments.

AB 1950 order:

8/2:  Referred to probation.Brown can appear via zoom for the petition hearing on 8/22 .

8/22: Continued to 8/28 because Judge Timothy Canning is recused.
