Attorney General sides with Humboldt DA, Acosta's Pitchess motion rejected on technicality, jury trial postponed to September

Yesterday was trial confirmation for local attorney Michael Acosta and Sarah Carroll. The jury trial scheduled for 7/24 was vacated. I said so in previous posts. 

There is already a hearing scheduled on 7/17 for Acosta's motion to disqualify DA and motion of change of venue which  have reported.  A hearing has been scheduled on 7/31 for Acosta's motion to dismiss for denial of equal protection. The DA filed an opposition to disqualify. The State Attorney General filed an opinion in opposition to Acosta's motion to recuse the Humboldt County DA.

Acosta keeps filing motions and there is a hearing almost every week or a rejection letter. Acosta's Pitchess motion was rejected because proof of service was not complete. I am sure Acosta will refile.

Trial assignment is on 9/1; jury trial is on 9/5.

Deputy District Attorney Ian Harris is the prosecutor. Acosta is representing himself. Ms. Andrea Sullivan was court appointed to represent Carroll.

I am not doing a post for every motion between now and the trial. Finally, on 7/13, motions were added to e court and they are included in the post.

There is a lag in court minutes and documents being loaded. As of 7/13, the 7/10 court minutes are still not in e court. Susan Edwards, the judicial secretary has the file which I cannot get access to and I put in a request to view it over a month ago.
