John Chiv: Until Judge Canning issues his ruling, the TRO against Brett Watson was extended to" remain in full force and effect"

After the conclusion of testimony in the lawsuit filed by City of Arcata against Brett Watson this week, Judge Timothy Canning said he would issue a written ruling which is expected by or before March 22.

The City of Arcata wants Judge Canning to make the temporary restraining order issued against Watson permanent. After yesterday's hearing, Judge Canning issued an order that the TRO remains in effect until 3/22/23. If the restraining order is made permanent, then is it necessary to wait until April for the hearing in Watson's parole violation case?

Judge Kelly Neel outlined the criteria for a restraining order in the lawsuit filed by Kim Bergel against Cornelius Loewenstein.

I read the court documents. The testimony in court does not change anything. Watson is not on Arcata City Council anymore, he filed a declaration regarding firearms, there is no threat anymore or reason for Watson to have contact with the City of Arcata. These parties can block Watson on social media, email, their phones and if they see him in public, walk away. Call 911 if he follows them or if there is a valid reason.

If Judge Canning is going to grant a restraining order on looks and discomfort and on imaginary possibilities that Watson's path may cross that of any of the above parties from the City of Arcata then he should do the same for attorneys, police and me. We get threatened with actual harm often and daily by people who we do and will encounter.

3/17: I expected Judge Canning to make the TRO permanent It was granted for 3 years.
