Rolling Meadow loses sanctions in NEC lawsuit but demurrer is sustained

 On 9/29, there was a case Management Conference, demurrer and motion hearing sanctions requested by Rolling Meadow Ranch LLC. in the lawsuit filed by NorthCoast Environmental Center, Redwood Region Audobon Society and Citizens for SustainableHumboldt against County of Humboldt, Humboldt County Board of Supervisors and Rolling Meadow Ranch LLC.

Judge Barry Goode sustained the demurrer without leave to amend. Sanctions were denied. A notice of appeal has been filed in February 2023. There was also been a substitution of attorney filed in February 2023. 

Rolling Meadows Ranch was requesting $16,080.00 for reasonable attorney fees and costs for one motion, and an order striking certain causes of second amended complaint. The notice cites lack of evidentiary support, frivolous legal contentions, improper purpose, harassment, delay and to increase cost of litigation.
