Three years later, same old delay, same old reason for continuances in 2020 manslaughter case

 


Voluntary manslaughter suspect Pamela Millsap's 2020 case has had continuance after continuance. The victim was her 17 year old son.

A motion to continue was heard last October.  It was granted for good cause which was to file a 827 petition. The 827 petition allows the release of juvenile court records. That is the same reason now and has been for a while. What is the delay and why is the Court not ordering these records released?

Judge Kaleb Cockrum is very familiar with this case. He presided over the preliminary hearing. Judge Cockrum knows about the number of continuances and the 827 petition being used to delay the case. By the time this case goes to trial, if Millsap is convicted, she will have racked up so many custody credits that any sentence is meaningless. This isn't the only Humboldt case and murder case where this happens. 

This is the third case I have checked today where a jail bed is tied up because Humboldt judges issue continuances like Halloween candy. Good cause has no meaning in Humboldt because it is used too often to push the backlog down the line. If you are in custody and cannot afford to post bail, tough luck. 

Most of the Judges who were on the bench when I first started this blog are now retired. The difference is apparent daily in courts. Some judges are too casual and too friendly with attorneys in certain courtrooms. Wearing the robe does not get the respect, how you conduct yourself does. 

Convicted rapist Kailan Meserve's habeas corpus hearing was delayed for months and now closing arguments have been continued to end of May. His attorney requested that Meserve hang out at the Humboldt Hilton instead of being sent back to the CDC.

Convicted sex offender, repeat parolee and peeping tom Charles Flinn is sitting in Humboldt jail after a plea in his recent case because his attorney could not be bothered to file a PPR report and the courts want Flinn held until the end of March for that report. This is part of the reason criminals are released on O.R. from the jail.

3/27/23: Motion to continue granted. 4/3/23 date vacated. Trial confirmation rescheduled for 6/8; jury trial 6/20.
