"Windy Dare is either naive and indifferent or an accomplice to what happened to her daughters."


Deputy District Attorney Whitney Timm started her closing argument by showing photos of Jane Doe #1 and Jane Doe #2 when they were little girls.

"These two girls knew the real Mark Dare," said Ms. Timm. "The Mark Dare that exists when no one is looking. That list is 16 people longer."

"For years, he slithered through our community portraying himself as a good guy. He tried to use the same tactics in court. It didn't work."

Ms. Timm mentioned Mark Dare's "deviant sexual interests"; mentioned that "the truth was exposed" over the course of this trial.

Using a power point presentation with key jury instructions, timelines, highlighting key testimony and evidence, the law and the elements of each charge, Ms. Timm in an articulate, organized closing argument and rebuttal effectively and efficiently summed up the People's case.

CALCRIM 226, 223 and 301, 1191 and 1191 b were jury instructions Ms. Timm mentioned.

The videos were not played. Very briefly, we saw two photos from the two videos shown to the jury. The young girl licking whipped cream from her fingers and the young nude girl from the waist up. The photos were cropped so the media and public only saw the faces. 

Regarding the defense character witnesses, Ms. Timm said, "All of us know someone who can come into court and say we are a good person. They knew Mr. Dare from work; from church. They don't know who he is; you know Mr. Dare better than those people."

Using a few examples, Ms. Timm reminded the jurors of the inconsistencies and changing testimony of Mark and Windy Dare.

"Paul Dare looked at his father the entire time before he answered." We all saw Paul Dare testify and pause and do this while he was on the stand. Ms. Timm then reminded jurors that Mark and Windy Dare discussed trial testimony with Paul Dare and told him what questions to expect.

Deborah Buck was another witness who was told about the trial testimony.

Ms. Timm mentioned Mark and Windy Dare's sex life included uraphilia. In addition to this being one of the many things we learned about Mark Dare in this trial such his porn and sex addiction, his web searches for young and teen, his affairs, his favorite sexual position; this fact is relevant because an expert testified that if a person is into one paraphilic disorder, the likelihood of that person also being into another disorder such as pedophilia is likely.

Ms. Timm mentioned the People's rebuttal witness, Ms. Gott, a prostitute who came and testified about Mark Dare in front of 16 strangers.  

In her rebuttal, Ms. Timm said, "Windy Dare is either naive and indifferent or an accomplice to what happened to her daughters."

Ms. Timm ended her rebuttal argument by saying to the  jurors whether Jane Doe #1 and Jane Doe #2 "get justice is up to you."

Jane Doe #1 walked out twice during Public Defender Marek Reavis' closing. His closing, like the case the defense presented was useless with the same tired claim it is not Mark Dare's porn and the girls made this all up and as Ms. Timm said, "trashing Jane Doe #1's reputation.

Even if either side had not presented closing arguments, Mark Dare would have been convicted. This was one of the best juries I have seen. They paid attention to every word, every piece of evidence; even Mr. Reavis' rants and ramblings which went on for hours. I have pointed out in my previous coverage of this case where Mr. Reavis' style, his incompetence has backfired in other cases. He has lost to Ms. Timm at every stage of this case and with different judges. She knows the law, she has her evidence and she is an excellent attorney.

I have seen her do two recent jury trials. I have seen Ms. Timm argue different hearings. With most attorneys, they have a basic template. With Ms. Timm, it is different with each case. I learn so much about the law watching her with each case.

I feel the same way about Mr. Trent Timm. They are an asset to the Humboldt County District Attorney's office; the kind of prosecutors you want representing the People.
