People and defense cannot agree regarding NGI stipulation in Antone Aubrey case



Jury trial for murder suspect Antone Aubrey scheduled for July 13 was confirmed at trial assignment today.

District Attorney Maggie Fleming said, "There has not been a waiver of jury yet as to both the guilt and NGI phases." I checked with her based on remarks back and forth during this morning's hearing.

However, whether it will actually proceed will not be known until this afternoon. It could start Monday.

Only one trial can proceed next week, according to Humboldt Superior Court Operations Manager Kelly Nyberg. Another no time waived case is also scheduled for July 13.

That case and Aubrey case will be called this afternoon. Defense and People cannot agree on a stipulation that would resolve the case. Defense offer was that Aubrey plead to the murder but there is a stipulation regarding not guilty by insanity.

DA Maggie Fleming said People will not stipulate to the NGI. Defense has experts and witness scheduled for Monday.

Deputy DA Candance Myers is the prosecutor for the case.

Afternoon update: Aubrey will enter a waiver to his right to jury trial on July 13. His court trial is a go with Judge Christopher Wilson. Pre trial discussions in the morning about stipulation to witnesses and testimony.  The People's case is expected to start Monday afternoon.

Three defense doctors will appear via Zoom and are scheduled for Wednesday. Defense does not want a bifurcated trial.
