Preliminary hearing continued for Michael Acosta and Sarah Carroll
Preliminary hearing for local attorney Michael Acosta and Sarah Carroll case was scheduled for this morning. Carroll has a misdemeanor case and that is trailing the felony case.
Judge Lawrence Killoran, Judge Kelly Neel, Judge Christopher Wilson and Judge Kaleb Cockrum all disqualified themselves from the case.
Mr. Acosta is representing himself. Carroll is represented by Mr. Russ Clanton. Deputy District Attorney Jane Mackie is the prosecutor for this case.
After hearing from Mr. Clanton, Mr. Acosta and Ms, Mackie, Judge Timothy Canning granted Mr. Clanton's request to continue the preliminary hearing and schedule a setting.
Setting and confirmation of receipt of discovery is scheduled for June 29.
Ms. Mackie did not object to the setting. Mr. Acosta did object to the continuanc. He has not waived time. However due to emergency rules due to the COVID 19 pandemic and finding good cause for Carroll, Judge Canning said good cause also applies to Mr. Acosta.
Mr. Clanton said Carroll wants to be personally present for the preliminary hearing; he has not met with her and has only been brief contact with his office. Mr. Clanton said he does not have all the discovery and he needs that before he can discuss the case with his client.
