Minor victim "described his penis as 6 inches while erect and bent to the left"

EPD Officer Timothy Marsolan was the first witness and only witness who has testified for the People in convicted human trafficker David Anderson's case. Then SART nurse Jennifer Hobie testified. As of 2:40, EPD Det. Amber Cossetti was the last People's witness.



Although the alleged victim's mother and the mother's boyfriend's full names were mentioned on record, I will not be including them in my post as they would identify Jane Doe.

Alleged victim was a juvenile Caucasian female with blond hair.

On November 8, 2018, Officer Marsolan was dispatched to a call at approximately 10:18. He went to St. Joseph's hospital. There was a report of a victim of alleged rape. Her family was with her. Upon arrival, he made initial contact with Jane Doe's mother, her boyfriend and an acquaintance. Officer Marsolan spoke with the minor's mother and boyfriend.

The mother told Officer Marsolan that "her daughter had been raped earlier this evening. She instructed her boyfriend to pick up her daughter from a local restaurant and bring her home and then to St. Joe's." The mother contacted law enforcement.

The mother "was very worried and concerned about harm on her daughter and advocated for a SART exam. The mother's boyfriend had picked Jane Doe from Denny's in Eureka.  Officer Marsolan contacted Rape Crisis Advocate to speak with the family and Jane Doe.

Detailed and graphic description of the alleged acts, his genitals, his clothing, Anderson's vehicle, his apartment complex and her escape was provided by Officer Marsolan. A SART exam was conducted.

"Jane Doe said she was raped by the subject. The male put his penis in her vagina and butt and she also performed oral sex on him."

Jane Doe told Officer Marsolan that "he held her down and pulled on her hair while performing this on her."

Jane Doe described Anderson as "African-American, 5 feet, 11 inches/6 feet tall, heavy build, large nose, his facial hair, prescription glasses, having dreads, described his chest as hairy, smelling of sweat and marijuana, described his genitals, described his penis as 6 inches while erect and bent to the left."

When Jane Doe told Anderson her age, he told her people like young ones.

When she said she would leave naked,  Anderson blocked Jane Doe from leaving by standing in front of the door an put his penis in her "butt."

She screamed and he switched to vaginal sex. Jane Doe said she had never had anal sex before.

Jane Doe said stop several times. "Stop. Stop. I can't fucking move. I want to go home. Let me go."

Jane Doe admitted to the SART nurse she had used meth before but had been clean for three months.

Jane Doe told Officer Marsolan that Anderson held her jaw open while be made her "suck his dick."

Jane Doe was consistent in her account to Officer Marsolan, the SART nurse and to friends on social media.

Mr. Acosta's cross, so far,has not impeached Officer Marsolan's testimony. The only new thing we learned during cross was that the alleged victim drank whiskey.
