Convicted murderer Jacob Steele gets Lake County attorney and date set for Franklin hearing
Jacob Steele setting of Franklin Hearing for Jacob Steele was scheduled this afternoon. Steele's case has been in limbo because the Public Defender as well as court appointed private attorney, Ms. Andrea Sullivan, had to declare conflict.
Lake County attorney Thomas Feimer was court appointed. Today, a pre trial hearing was set for August 7; the Franklin hearing for August 28.
Deputy District Attorney Tobias Hasler was present for the People.
Convicted murderer Jacob Steele was convicted of second degree murder of Jerry George in 2012. Steele is not eligible for parole until 2034.
He was transported back from State Prison to Humboldt for a Franklin hearing/resentencing. Steele Steele wants to file a writ of habeas corpus.
8/7: Deputy District Attorney Whitney Timm appeared on the case for the People. Mr. Feimer said he had requested discovery from the D. A.'s office and asked for a continuance saying, "Mr. Steele has the Franklin claim and other issues."
Mr. Feimer said that there were difficulties with witnesses due to COVID restrictions.
Judge Christopher Wilson said,, "A Franklin hearing doesn't require anything other than evidence from the parole hearing."
Mr. Feimer referred to notice of ex parte motion filed by Steele to subpoena confidential, he said "it is along title. I construe it as a writ of habeas corpus. It could be dealt separately from Franklin hearing.
Judge Wilson requested a written motion to continue. An interim date of August 25 was scheduled.
8/25: Deputy DA Steven Steward did not object to Mr. Feimer's request for a continuance. Defense has applied for funding to have Dr Kevin Kelly do a psychological report. Setting of Franklin hearing is scheduled for September 18.
