District Attorney Maggie Fleming explains why extraditing Reynaldo Valenzula is not feasible


District Attorney Maggie Fleming sent this response to my asking if her office planned on extraditing Reynaldo Mendoza Valenzuela.

"I do not have plans to extradite Valenzuela because his extradition from Mexico is not feasible.  Mexico only allows extradition under exceptional circumstances."



"As you know, Valenzuela jumped bail.  The feasibility of extradition is relevant to the issue of offering bail to people who might flee to another state or country.  The law allows that when extradition is feasible and a District Attorney chooses not to extradite, companies who provided bail for someone who flees can receive a refund of that bail.  However, when extradition is not feasible, bail companies take the loss when someone jumps (see County of Orange v. Ranger Ins. Co. (1998) 61 Cal.App.4th 795). "

In my previous post, Steve Payton, owner of Bill Davidson Bail Bonds said he had been referred to the County Counsel's office.
