Bail reduction request for alleged molestor Michael Franco could result in a bail increase to 4 million, 50,000


Bail reduction/motion to adjust bail for alleged molestor Michael Franco was continued to January 10. Ruling on the motion was continued by Judge Christopher Wilson to January 16.

Bail is currently set at 2.8 million. People requested an increase to 4 million, 50,000.

Franco is facing nine counts of alleged sexual acts involving a minor in Humboldt. He already has a prior conviction out of Los Angeles County for a sex offense involving minor.

Trial setting is scheduled for January 24.

Deputy District Attorney Josh Rosenfeld appeared in court today for the People since Ms. Stacey Eads is in jury trial.

Mr. Rosenfeld opposed any reduction in bail, telling Judge Christopher Wilson, that if there were any adjustments, the bail should be increased.  Mr. Rosenfeld broke down the charges  including the potential life sentences Franco faces. He said Franco has been "in prison for similar acts." Mr. Rosenfeld mentioned that Franco has no ties to the community and "comes up here to molest children.,"

Franco's attorney, Mr. Russ Clanton said the current bail amount "was an affront to the system." Franco has a place he can stay at locally and would agree to conditions such as electronic monitoring.

"This is the kind of case where the statute is in limbo," said Judge Wilson. "Given the nature of the charges", there would be no bail. Judge Wilson said he was going to rule next  week and look into PC 654 as it applies to PC 288 charges.
