Seng Yang asks for a Marsden motion last minute, it is denied. Now, jurors, victim, everyone waits as Yang manipulates the legal system


Jury trial for Seng Yang was scheduled to start August 27. Yang is charged with 16 counts which include forcible rape of Jane Doe (his own daughter) and exhibiting a in pornography.  Jane Doe is the alleged victim for all counts.

Public Defender Marek Reavis met privately with Yang this morning, then the courtroom was closed for a Marsden motion.

When the courtroom was reopened, Judge Dale Reinholtsen said Yang's Marsden motion was denied.

Then there was another last minute twist today. "He believes our relationship is broken," Mr. Reavis said to Judge Reinholtsen. "He would like the opportunity to research and hire a private attorney. " Yang wants the jury trial delayed and he agreed to waive his right to a speedy trial.

"I am ready to proceed," said Mr. Reavis. "I have informed Mr. Yang it will be costly and a retainer can be up to $75,000 or $100,000."

Deputy District Attorney Stacey Eads said, "The People are ready to proceed. The victim has been on an emotional roller coaster."

Judge Reinholtsen said, "We have previously brought in jurors who have filled in hardship questionnaires and the second questionnaire. Jurors are waiting to hear if they should come back Tuesday afternoon."

"There is some confusion in Mr. Yang's mind what it means to start a jury trial," said Mr. Reavis. He asked if the Court to explain toMr. Yang and that he had tried. Whether Yang has the resources to hire a private attorney was also brought up.

Judge Reinholtsen "continued the matter until 1:30". Judge Reinholtsen said he may chose to have a further Marsden this afternoon.

At trial confirmation Yang rejected the DA's offer of 39 years. At trial assignment Friday, his case was scheduled in the morning and again, in the afternoon. At 3:30 on Friday,
attorneys met privately with Judge Dale Reinholtse. Then Public Defender Marek Reavis spoke privately with family members. The courtroom was not opened but Mr. Reavis spoke briefly with family members outside.  Mr. Reavis told the family he  would meet with Yang this weekend. Yang requested a Marsden motion on Friday, the weekend before his jury trial is suppised to start.

A Hmong court certified court interpreter is required for Yang. The two that are available and have interpreted for Yang have to come to Humboldt from Sacramento. Yang is not paying for any of his legal expenses.
