Russo in, Sanders out. Judge Wilson explains to Lorna Leen when the County is paying she does not get to choose her attorney


Intervention was scheduled this afternoon in Lorna Leen's case. Preliminary is scheduled for August 23. She is charged with murder. Victim is Brandon Brocius.

Mr. Neal Sanders was representing Leen after it was determined at the last hearing that the Public Defender had a conflict. However, Mr. Sanders' appointment was vacated today. The Public Defender did not have a conflict. Deputy Public Defender told Judge Christopher Wilson that due to an error, the determination of conflict and confirmation of counsel ended up being a declaration of conflict.

Leen wanted to keep Mr. Sanders as her attorney. Judge Wilson told her she could retain Mr. Sanders but she did not get to chose when the County is paying her legal expenses.

Due to reasons stated by Mr. Russo as well as Deputy District Attorney Roger Rees, Judge Wilson found good cause and granted an oral defense motion to continue the preliminary hearing until September 5. Intervention is scheduled for August 29.

Mr. Rees is in trial right now. There is "voluminous" discovery  including additional discovery yet to be submitted to the defense. That additional discovery "may not" be here in time for August 23, said Mr. Rees.

Leen entered a 10 day waiver.
