Does the recent funding order by the defense in the Marci Kitchen case mean probation or a suspended sentence?


"Possible reasons for an funding order in the Marci Kitchen case. I did this once in a 3-Strikes case. I hired somebody to prepare a Defense Sentencing Report. It could be for that but most likely it is for an expert on substance abuse, perhaps that new alcohol mental disorder offense. Other incarceration options."



"It is the job of that Defense Attorney to think or do anything that will reduce the prison sentence. In theory, Kitchen in theory could still get probation. She is not statutorily ineligible for probation. She could even get a suspended sentence of up to 10 or 11 years. There was probably lots of discussions in chambers and the Judge probably said something. Most Judges say, "Now this is just me thinking out loud, but what about..." Ms. O'Connell must have had an inkling, a hope or something that this could work out for her client. "
