Judge Feeney denies placement of Joshua Cooley in Freshwater area



Denial of placement in the Freshwater was Judge John Feeney's tentative decision, which was then his final decision. He had to reiterate that a few times, after public comment.

Judge John Feeney suggested that Liberty Healthcare seek an urban or city placement for sexually violent predator Joshua Cooley.

"The issue is moot," said Conflict Counsel Supervising Attorney Meagan O'Connell. She referred to a conversation she had with Liberty Healthcare who told  her that the landlord of the Howard Heights property could not abide by an addendum to the contract.

Liberty Healthcare regional coordinator Timothy Fletcher was present. He said when he inspected the property, he told the landlord that marijuana had to be removed from a shared area on the property. The landlord told him on August 21 that she unable to remove marijuana from that shared area on the property.

Cooley was released according to the California conditional release program. His initial petition was denied by the courts he appealed.

"The People are opposed to any placement of Mr. Cooley outside Coalinga."

Another Humboldt County placement is not out of the question nor is a transient placement, which means Cooley would be placed in hotels, being moved every three years. Those hotels would not get notice.

"This is not about punishment for Mr. Cooley, it is about what is safe for the People " said Ms. Eads.

With her voice shaking, Ms. Eads told Judge Feeney that "there was a violent rape of a 12 year old girl. "She said a cohort participated in that rape.

Ms. Eads brought up Cooley's refusal of treatment and services offered at Coalinga State Hospital, his sexual preference for young girls, sexualized violence.

As both Deputy District Attorney Stacey Eads and Conflict Counsel Supervising Attorney Meagan O'Connell pointed out, Cooley served time for his conviction. The placement in Coalinga was a civil commitment.
