Alleged molestor Chad Smith's jury trial set on the same day as alleged molestor and court clerk John Beideman's trial, for now


Trial setting was scheduled at a special set time of 1:30 this afternoon for alleged molestor Chad Smith. For now, Smith's trial is set for November 5, the same day as alleged molestor John Beideman.



Smith's attorney Ms. Andrea Kaluna-Sullivan suggested October 22.  That did not work for Deputy District Attorney Stacey Eads who suggested December.

At that point, Ms. Sullivan indicated to Judge Dale Reinholtsen that Smith said he would pull his time waiver because he did not want the jury trial to be set in December.
"I am trying to keep time waived" for the convenience of both parties. Defense experts have Smith's files.

A case Ms. Eads is prosecuting. Ms. Sullivan has a practice in Lake County. She also has other cases including another high profile Humboldt case scheduled for jury trial coming up .She is representing Joe Olivo III in the Jesus Garcia case. There are two other co-defendants in that case.

The defense experts have Smith's files, said Ms. Sullivan.

Ms. Eads has the Mario Alexander case, the Marci Kitchen case.

So one or the other side may end up filing motions to continue.
