I had already written weeks back about a possible change of venue for Marci Kitchen so today's filing is not breaking news or anything unexpected


Judge Kaleb Cockrum had told Conflict Counsel Supervising Attorney Meagan O'Connell to file a defense motion in the Marci Kitchen case by August 3. The defense expert is expected to finish an investigation by August 23. A supplemental motion to the August 3 filing will be filed by August 24.



I had already indicated previously a motion to continue and a motion for change of venue could be filed by the defense. That post also included the community was being polled and was prior to the last court hearing when dates were given out in court about when motions should be filed.

So none of this is unexpected. Motions in limine and jury questionnaires are to be filed by or before August 6.

The motion to continue was filed and granted at the last court hearing. Those are  posts linked below. There is a procedure and criteria to be met to grant a change of venue. The case has not even been through jury selection yet.

People getting called and polled on their opinion on the Kitchen trial are not neccesarily the ones who will be in the jury pool and as proved in other cases such as Gary Bullock and Jason Warren, once jury selection starts, through voir dire, it is possible to find a jury in Humboldt County.


The hearing on change of venue is set for August 27 in Courtroom 2.  Trial confirmation is scheduled for August 9.The jury trial is scheduled for September 4.
