Mexican citizen Hugo Aguirre 's dilemma: be declared incompetent or face 60 years to life


The Court appointed UC Davis Training director Jessica Ferranti to do a second evaluation of Mexican citizen Hugo Parral Aguirre. Ferranti is expected to evaluate Aguirre on March 31. The People are going to pay for the Ferranti, not the taxpayers.

Deputy District Attorney Josh Rosenfeld had not seen the copy of the defense's brief filed on February 9. This was Friday and courts were closed  on Monday. He was provided a copy in court. After a brief recess, the courtoom was opened and Visiting Judge Arvid Johnson heard arguments from both attorneys before his ruling.

Like the previous two hearings, Aguirre was not happy with this whole incompetency thing but if this case goes to trial and he is found guilty, he faces "60 years to life", according to Deputy District Attorney Josh Rosenfeld.

Deputy Conflict Counsel Meagan O'Connell objected to the appointment of Ferranti. She also objected to tbe release of two subpoenas from the correctional facility requested by the DA. They are Aguirre's medical and psychiatric records. A hearing on the release of those records is scheduled for March 12.

This hearing was continued to February 13 so  Humboldt County Superior Court Judge would whether a second doctor should be appointed to evaluate Aguirre.

However, Visiting Judge Arvid Johnson was in Courtroom 5 today and the attorneys did not object.

The arguments where pretty much the same as last time with some new clarifications.

My favorite quote from this morning was from Mr. Rosenfeld. "I am not aware of any statutory limitations on evaluations."

The defense submitted on Dr. Michael Ramirez's report. He found Aguirre not competent to stand trial at this time.

The People did not submit on Dr. Ramirez's report. The previous post from January 26 details arguments presented by both attorneys. They were to file written briefs to supplement those arguments before today

Criminal proceedings have been suspended in the case. Aguirre is charged with the attempted murder of a HCSO Deputy and assault of a HCSO Sgt.

A certified court interpreter, Ariana Rayburn has been at every hearing to translate for Aguirre.

  1. this SOB is a ILLEGAL alien!! Quit the touchy feely garbage, find him sane (oh boo hoo iberals) and do your court justice job judges-find him GUILTY and get this done.
