Defense gets an out of state subpoena issued for Rachel Goldberg
An out of state subpoena for Rachel Goldberg was requested by the defense and was signed by Judge Graham Cribbs this afternoon.
Even if Rachel Goldberg showed up or was brought to court, will she testify? Only Deputy Public Defender Casey Russo seems to think so.
Rachel Goldberg refused to testify at the preliminary hearing. This afternoon, after the jury had been sent home, Judge Cribbs and attorneys met to discuss outstanding discovery, motions in limine and anything that the attorneys wanted to discuss before opening statements tomorrow.
The defense was going to call 9 character witnesses for Jon Goldberg; that has been whittled down to a mere 8.
The defense wanted to exclude the excited utterance by Rachel Goldberg, the defense wanted to exclude any reference to the alleged domestic incident between the Goldbergs, the prosecution wanted to include evidence on a broken cell phone found at the Goldberg's residence but there has bee no evidence linking it to th Goldbergs. All these motions in limine have been discussed in private; there were some clarifications and today in open court Judge Cribbs gave an explaination on his rulings.
Like every trial, some evidence is allowed in, some isn't; there are some tentative rulings which maybe further discussed depending on how evidence unfolds so I am not going to write more details, for now. All I can say is it a pleasure to watch Judge Cribbs. He is fair. You can tell his 28 years of experience on the bench from the way he conducts himself. The best part is he is not pro prosecution or pro defense; he just follows and rules, according to the law.
The defense got some wins today; so did the prosecution. Judge Cribbs has a great grasp of this case; the legal history; the nuances.
People have still not received the discovery they need from local psychologist Dr. Andrew Renouf, one of the defense experts so they can prepare and call an expert of their own.
If you read my coverage of this case, including the two preliminary hearings, a lot of the trial testimony will be familiar.
I was the lone spectator in the courtroom audience this afternoon.
