Humboldt Superior Court Clerk John Beideman held to answer on five out of six counts in sexual abuse case

Judge Graham A. Cribbs held Beideman to answer on all counts except Count 1. Judge Cribbs said that while "I do not doubt the factual allegations, that testimony of Jane Doe stated a particular age that was different from the complaint which lists it as age 6. "The timeframes in the felony complaint are incredibly close to borderline and maybe subject to a 995 motion."

Beideman is charged with  six felony counts. Four counts of  PC 288.7(b), oral copulation/penetration on a child under 10, these allegedly happened between 2006 and 2009. Two counts of PC 288 (a), lewd acts with a child under 14. These allegedly happened between 2004 and 2009.

Jane Doe was a very credible witness and her testimony was heartbreaking.

Jane Doe and her mother testified today. Jane Doe was Beideman's stepdaughter. He was married to Jane Doe's mother Tina Marie-Hendrich Carver at the time of the alleged abuse.

Ms. Carver is married to someone else now. Jane Doe went to her current stepfather about the alleged abuse before she told her mother.

During cross by Beideman's attorney, Mr. Russ Clanton there were some inconsistencies between what Jane Doe said and what Ms. Carver said. Jane Doe said the bedroom was cracked for at least one incident and Ms. Carver said, "In my home bedroom doors get closed when people go to sleep" and that she never heard Beideman sing because the door was closed or she would be in another room.

Jane Doe said her bedtime was 7 p.m. Her mom said 8 to 9:30 p.m. Jane Doe never mentioned any arguments about her bedtime routine and Beideman being in her bedroom alone. Her mother said they argued about Beideman going back into Jane Doe's bedroom. Ms. Carver was also unable to answer some questions about her interviews with law enforcement.

Around the time, Beideman and Carver were on the outs and Beideman was moving out; her current husband, Clay was already in Ms. Carver's life. He had some "ill feelings" about Beideman and shared them with Jane Doe.

Mr. Clanton in his arguments said that regarding Counts 1 and 2, "there is no evidence to prove the elements. He said Jane Doe only felt sensation and that she could not observe penetration.

Deputy District Attorney Stacey Eads is prosecuting the case.

About 16 people, most of them Bikers Against Abuse, were in court today to support Jane Doe.  There was some texting in the courtroom by two people in the audience. Using your phone and texting is not allowed in the courtroom.

(There was previous court testimony about alleged abuse of Jane Doe in court; an observation by her third grade teacher. Yet, Beideman was only arrested on October 5.)

  1. I’m happy that the Bikers are there. Their organization can make victims feel safe. They do so much to help alleviate the fear that sexually assaulted children, and adults feel. Another banner story John. I really can’t comprehend how difficult it must be to hear all of these children testify day after day. Different faces with such painful memories of childhood’s lost. Thanks for being there, you’re doing important work.

    1. Thanks Majestic it is indeed. Testimony like this is hard to hear, listen and watch. I have covered many cases of rape, domestic violence and sexual abuse and not just locally. When I first starting writing and this was in traditional, mainstream media, it was harder for the victims. This kind of detailed reporting takes a toll on a person. Silence benefits the abuser, truth empowers the survivor.

Not all victims and their families shy away from coverage. Those that do are embarassed and use the victims to try and silence coverage of the case. People, including local media, are unaware of the developing changes and guidelines in covering these type of cases from respected institutions on journalism. Friends, advocates, activists see one side. Regular readers and many in the community who know me and know the risks I take to expose Humboldt's nasty plague of sweeping things under the rug are the ones bringing change in this community.

Thank you for your thoughtful comments and understanding of the victims.

  2. These stories must be told. Yes it’s gritty, ugly and disgusting but unfortunately it’s not uncommon. Shine the light on the monsters with the words of their victims.

    2. Most media superficially cover cases and go for headlines. The victims and families of both victims as well as defendants are personally grateful to me and stay in touch with me for years.

The girls' father in the Dare case abandoned them as well. Children should not be pawns in their parents' bad choices.

Behind every headline, especially in child abuse cases are facts that some in small town Humboldt is used to sweeping under the rug. False concern couched in any language is someone scared of the truth and selfish about their friends or family being exposed. silence only benefits the alleged abuser. If you care about the allegedvictims, support them in word and action and by recognizing there maybe other victims.

Easy to comment online or show up for a hearing or occasionally one case. Work to bring change to prevent future victims and help present victims feel safe by focusing on helping them and honoring their courage to speak up and bringing the issue of sexual abuse to light.

    3. I totally missed that the Dare Victim’s bio-father threw them away too! This is frequently a common factor is dysfunctional families, but I thought these girls had at least one parent on their side. I feel so profoundly sad for them. Their story is extremely close to my own in many ways. This world can be so unfair. My heart goes out to them.

  3. My eighty year old Mother not only recounted abuse to her as a child she also recounted her Mother's and Grandmother's. Sadly it's nothing new. Sending offenders off to Prison to masturbate their lives away like we always have Sooooo obviously has not been working. We all know what is going to work. Parenting and and Swift violent punishment.
