In a preliminary that lasted an hour and half, EPD Detective Ron Harpham testified in great detail about the 911 call, the body cams worn by the three officers who arrived simultaneously, within minutes of the 911 call to see David Kobak still on the phone.
Detective Harpham described specific of shell casings and bullets found on the scene and several statements from the alleged confession Kobak made on the 911 call about shooting his friend Frederick Loftus.
According to testimony today, Kobak made spontaneous comments while being detained and walking to the patrol car by Officer Ben Altic and again during his interview with Detective Harpham despite being advised of his Miranda rights.
Through testimony, it was revealed both men were drinking, both would act differently when drunk, no drugs found at the crime scene, a semi automatic rifle was used to shoot Loftus. Out often bullets on the scene, 8 bullets found in Loftus.
Kobak would not tell Detective Harpham the nature of the insults that Loftus directed towards him before he shot Loftus but he did say that Loftus hit him two or three times in the face and did not leave any marks.
