Local attorney Delman Smith and his wife suing City of Eureka and County of Humboldt because a pothole, unsafe roadway caused him to lose control of his bicycle and "violently crash to the ground."

 

On December 23, 2025, I reported on a lawsuit filed by local attorney Delman Smith and his  his wife Hazel Smith against the City of Eureka and County of Humboldt. They have hired Zwerdling Law Firm. Mr. Richard Dalrymple is listed as their attorney.

Documents were entered into e court yesterday. The personal injury lawsuit alleges premises liability and loss of consortium. Delman Smith was riding his bicycle on Chester Street and "encountered a dangerous and unsafe condition of the roadway, including a pothole and related surface defects." The lawsuit claims this caused Delman Smith to lose control of his bicycle and "violently crash to the ground."

Case Management Conference is scheduled for 6/15/26.

1/28/26: Humboldt Deputy County Counsel filed a response to the Smith lawsuit asking the entire action be dismissed with prejudice; judgement be entered in favor of the County; Smith get "nothing";  the County be awarded costs for defending this action and any other relief the Court deem proper.
