A resentencing hearing is scheduled for convicted murderer Jon Goldberg

 



These were the last posts I did on convicted murderer Jon Goldberg's 2016 case.

Goldberg lost his appeal. His petition for rehearing was denied. His petition for review was denied in the Supreme Court. Goldberg's habeas petition was denied by Judge Charles Breyer.

Goldberg was sentenced for the 2nd degree murder of Tim Smith. His sentence was 15 years to life.

On 1/13/26, there was a hearing scheduled in Humboldt Superior Court.

CDCR  still shows him in custody.

On 11/4/25, there was a resentencing hearing PC 1172.1. 

California Penal Code (PC) 1172.1 allows courts to recall and resentence individuals whose prison sentences are deemed excessive or no longer serve justice.

Goldberg granted parole according to defense who requested resentencing in front of Humboldt Superior Court Presiding Judge Kelly Neel, DA requested continuance to contact victims. 12/4/25, continued by court, order to produce prisoner by Zoom signed by Judge Neel on 12/23/25. The 1/23/26 resentencing hearing rescheduled to 1/30/26.  

Today, was a Readiness conference in Courtroom 3 for today in front of Judge Steven Steward. It was just to confirm of the 1/30/26 resentencing hearing. Thanks to Humboldt County Public Defender Luke Brownfield for clarifying.

Former DA Maggie Fleming who works part time at the Humboldt County DA on certain cases is appearing on the case for the resentencing. Deputy Public Defender Casey Russo is Goldberg's attorney.
