Rape, kidnap charges dismissed; convicted felon resolves case for 9 year prison sentence

 


On Oct 31, I reported that right before convicted felon, kidnapping and rape suspect Shannon Campbell's jury trial was scheduled to start, Deputy District Attorney Luke Bernthal said the people intend to dismiss and refile. There was a first amended information filed and the difference in charges was that a strike was added to Campbell's charges. The 2022 case was dismissed. Campbell was arraigned on the 2023 case.

A two day preliminary hearing was scheduled which started on November 13 was supposed to continue on November 14. Instead, on the second day, the case resolved. This is how a skilled defense attorney negotiates a plea deal in a case despite having a client like Campbell and the charges he faced. The job of the defense attorney is not to like, condone the client's acts but to protect the client's rights, due process and get the best plea deal; if they can.

Campbell was facing a potential life sentence but on the second day of preliminary hearing, a conditional plea of 9 years was negotiated. Four counts were dismissed including the rape and kidnap charges. Ms. Andrea Sullivan is a private attorney and was court appointed on Campbell's case. Sentencing is scheduled on 1/12/24.
