Forcible rape and domestic violence suspect Brandon Shorey's preliminary hearing scheduled for 11/14 was continued to 11/16 because his assigned Deputy Public Defender David Nims was ill. Deputy Public Defender Casey Russo asked for the continuance. Deputy District Attorney Luke Bernthal appeared on the case for the People and was the prosecutor for the preliminary hearing.
On 11/16, Shorey was held to answer to Counts 1 forcible rape, 2 forcible oral copulation and 3 domestic violence. Judge Joyce Hinrichs did not find enough evidence for the special allegations for each of the three counts involving a knife. Arraignment on information for the rape case is scheduled for 11/30.
Shorey has another 2023 case for assault which is trailing this case. Pre trial scheduled in that case was continued by stipulation to 11 /30.
11/30: Shorey was arraigned. Trial confirmation on 1/10/24; jury trial on 1/22/24.
