New additional NGI plea for Coley and DA files new charge that could result in death penalty, life in prison or no possibility of parole

 


Murder suspect Jasen Coley's case is on for appointment of doctors and arraignment on information this morning. Attorneys met with the Judge Joyce Hinrichs in a closed courtroom and the 9:15 calendar is running late, as usual. Judge Hinrichs choses to do this for the 9:15 calendar and it doesn't help move things along. Meanwhile attorneys and people are jammed into the chaotic second floor with two jury trials and family law parties airing their drama daily in front of others. Humboldt Superior Court has information and public computers right next to Courtroom 5.

There are several cases on this morning so when this case will be called and when it will conclude is the daily Humboldt court roulette.  There are some new developments and those exclusive details are being posted live before court. 

Coley had already entered a dual plea of not guilty and an additional plea of not guilty by reason of insanity. I just spoke with his primary attorney, Mr. Michael Robinson, and Coley is expected to enter dual plea of not guilty and additional NGI plea.

I checked the case in the computer and on 10/25, the DA filed the information. In that filing, an additional special allegation of PC 190.2 (a) murder by "intentionally killing the victim by means of lying in wait". Mr. Robinson had no idea until I told him before court. This is a special circumstance murder charge that can result in life in prison or no possibility of parole or the death penalty if Coley is convicted.

Coley was arraigned on information which includes the new special allegation. Coley entered a dual plea, not guilty, not guilty by reason of insanity. Coley did not waive time. Mr. Dustin Owens is c-counsel and will assist Mr. Robinson with expert witnesses.

Trial confirmation is scheduled for 11/20; jury trial  12/11. As expected, defense submitted Dr. Robert Soper as  expert and doctor for evaluation. DA submitted two names from an expert witness bureau in Southern California. Due to the no time waiver, Ms. Myers will check availability with People and advise Court.
