No plea for Cullen, instead motion to continue trial and 995 motion to be filed by defense



Trial assignment and possible change of plea was scheduled this morning for convicted felon Robert Cullen. Jury trial scheduled for July 6 was vacated.

Cullen has a 2019 case and two 2017 VOP cases. In his most recent case, Cullen is charged with 14 counts.

At the last court hearing, the People's offer was for 6 years, 4 months. There was no mention of a plea. Instead, Mr. Michael Acosta,  Cullen's attorney, made an oral motion to continue trial. Mr. Acosta also plans to file a 995 motion.

Deputy District Attorney Jane Mackie said she had no objection to the motion continue as long as Cullen waived time.

Cullen waived time. Trial confirmation is scheduled for August 26; jury trial for September 8.
