PD has conflict, Russ Clanton has conflict so Ulisses Rodriguez gets Andrea Sullivan appointed

Trial confirmation and setting of 1042 motion in murder suspect Ulisses Rodriguez's case was scheduled this morning. Jury trial scheduled for June 29 remains set, for now.

The 1042 motion was never heard this morning. Due to some discovery, Public Defender declared conflict. I t appeared Mr. Russ Clanton was going to be appointed.  Then it was revealed by Deputy District Attorney Roger Rees, that Mr. Clanton has a conflict since he now represents John Doe. Ms. Andrea Sullivan was appointed today.

Confirmation of Counsel is on June 16. Future dates will be discussed then.

Deputy Public Defender Ben McLaughlin had mentioned at the last two hearing that the currently set jury trial is unlikely to proceed. That was for other reasons and now Rodriguez has a new attorney.

Mr. McLaughlin said he was going to  file a 1042 motion to compel disclosure of the confidential informant; John Doe. Mr. McLaughlin had previously said Conflict Counsel represents John Doe. Since then, Mr. Clanton took over John Doe's case.

Mr  Rees' responses and comment on Evidence Code 1041 in response to a 1042 motion are in the post linked below.
