Pamela Millsap's 10 year old daughter saw her brother get shot


Murder suspect Pamela Millsap's preliminary hearing started this afternoon and will continue tommorow afternoon. Millsap waived her right to a continuous hearing.

Before the hearing started, Deputy District Attorney Whitney Timm stated a "pre prelim offer" which would have been a total of 12 year prison sentence and Millsap could have argued for probation. Millsap would plead to voluntary manslaughter "with a mid term cap of 9 years and gun enhancement for a low term cap of three years."

Millsap has not accepted the deal. At the end of the hearing, people are adding a great bodily injury enhancement.

Voluntary manslaughter in California is the killing of another human being during a sudden quarrel, in the heat of passion, or based on an honest but unreasonable belief in the need to defend oneself.

Millsap is charged in Count 1 with voluntary manslaughter of John Doe; her 17 year old son. Count 2 with child abuse; alleged victim is John Doe. Count 3  with child abuse; alleged victim is her 10 year old daughter Jane Doe and a special allegation that she personally used a firearmduring the commission of the crime; a shotgun.

Deputy District Attorney Whitney Timm is the prosecutor for the case. Deputy Conflict Counsel April Van Dyke is Millsap's attorney.

On February 18, 2020, at 7:22 p.m. EPD Detective Corrie Watson responded to a call for service at 2200 Union Street. She received a briefing from Sgt. Edward Wilson, EPD Officer Patrick Bishop and Officer Joseph Couch.

"Sgt. Wilson told me a shooting had occurred. The person who had been shot had been transported to the hospital.  The others were in patrol cars."

"EPD dispatch received a 911 call about a family disturbance. While officers were en route, the petson reporting said someone had been shot."

Officers Couch and Bishop were the first to arrive on scene. Officer Couch had left and "was at St. Joe's hospital." Det. Watson and Officer Couch spoke on the phone.

When Officer Couch arrived at the house, he found "a male subject with a gunshot wound to the abdomen."

Officer Bishop arrived at the same time. He assisted with medical efforts, secured the firearm and told others to leave the residence. Officer Couch observed "what he believed to be vomit and blood on the face and head of the victim. Blood exited during medical efforts."

There were two other people present at the time of the shooting. One of them was Jane Doe. She was sitting in a patrol car.Det. Watson spoke with her and scheduled a CAST interview for the next day. Det. Watson reached out to Jane Doe's biological father, Alexander B. He is Millsap's boyfriend.

While still on scene, Det. Watson was informed "the victim did not survive." Det. Watson notified Alexander B. and Millsap who was in the back of another patrol car. Then at Alexander B's request, Det. Watson told Jane Doe of her brother's death.

Officer Bishop had obtained a search warrant. Ms. Timm showed Det. Watson photos. Millsap, Jane Doe and Millsap's mother, Roxanne Wade had lived at the residence for 10 years.

EPD Det. Corrie Watson direct testimony covers Millsap's interview, then her daughter's interview, then Millsap's boyfriend's interview and one has to sort through allegations of Millsap being accused of performing oral sex on her son and the dynamics of this family which are a cross between an episode of Hoarders and the Jerry Springer show.

The only common facts are there was an argument that night, John Doe had issues at home, Millsap went and got a shotgun and sought her son out even though he had gone to his bedroom. They ended up in the living room, both had their hands on the shotgun and John Doe is dead.

Dr. Mark Super who performed the autopsy said that cause of death was a gunshot wound to the abdomen.

According to Millsap's own interview, she argued that night with John Doe buying his sister a hamburger with his own money. There were no weapons on John Doe. No weapons found in the house.

They were living in a house where the sinks didnt work, empty food containers and trash on the floor, staibed sheets. EPD had to move items to move around. The floor was not visible due to clothes and items strewn all over the house. EPD could not access a room because it was "barricaded" by belongings.

John Doe's toxicology results showed positive for cannabis and BAC of .16.

Cross examination of Det. Watson resumes tomorrow afternoon and the 911 call will be played. Defense has subpoenaed EPD Officer Young Porambo who heard statements made by John Doe towards Millsap.
