Instead of another Marsden motion, Seng Yang should be thanking Public Defender Marek Reavis for representing him well despite Yang tanking his own case
Alleged molestor Seng Yang filed another Marsden motion. The hearing for that motion is scheduled on February 4. His previous Marsden motion was denied on August 27 2018.
Yang is charged with 16 counts which include forcible rape of Jane Doe (his own daughter) and exhibiting a minor in pornography. Jane Doe is the alleged victim for all counts.
Text messages and pornographic videos are part of the evidence.
If you have been following the case regularly on this blog, you already know Yang has tried several tricks to delay the outcome of his case. It is not ineffective counsel if Yang cannot face the reality of the evidence against him. If anything, Public Defender Marek Reavis has represented him well; despite Yang's shenanigans in court.
Yang knew he cannot afford private counsel; yet he tried that nonsense. Now, he has filed a second Marsden motion. Yang had the opportunity to resolve the case. It was his choice to turn the DA's first offer. At the last hearing, instead of allowing his lawyer to negotiate, he wanted to directly communicate with Deputy District Attorney Stacey Eads. A court interpreter has to be brought in at taxpayer expense from Sacramento for every hearing. Visiting Judge Hurley noted on record at the last hearing that Yang speaks English.
A Marsden motion is the only court procedure by which a criminal defendant can fire a court-appointed attorney or communicate directly with a judge in a California state court. The motion is based on a defendant's claim that the attorney is providing ineffective assistance or has a conflict with the defendant.
