Richard Dean waives preliminary hearing for 4 cases; People dismiss one count, one special allegation and one case in exchange for the waiver




Preliminary hearing for murder suspect Richard Dean was scheduled on October 3. Dean was charged with the  stabbing of 52 year old Anthony Michael Pennucci. There were three other cases also on for preliminary hearing today.

Due to the busy court calendar, the case was not called until 11:07.

Dean waived his right to a preliminary hearing on all four cases. In exchange for that waiver, CR1702314 was dismissed by the People. Count 2 and the special allegation for Count 2 was dismissed in CR1505185. The People will  not refile on the dismissed charges.

Arraignment on three cases is scheduled for October 16 at 8:30 a.m.

A fifth case in the system was dismissed previously.

It has been two years since his arrest. Dean has been to Napa State Hospital and back.

The case is being prosecuted by Deputy District Attorney Stacey Eads. Dean is represented by Deputy Public Defender Ben McLaughlin.

Five family members and supporters for Dean were in court. He smiled at them.  Mr. McLaughlin met with them before and after the case.

The only other people besides Dean's supporters present in the courtroom audience when Dean entered his waiver were one HCSO deputy and me.
