Alleged molestor Michael Franco waives his right to a preliminary hearing


Preliminary hearing was scheduled for Alleged molestor Michael Franco waived his preliminary hearing this morning.



The case is being prosecuted by Deputy District Attorney Stacey Eads. Franco is being represented by Mr. Russ Clanton.

Arraignment on information is on November 13 at 8:30.

Ms. Eads told Judge Bruce Watson there was an off record discussion between her and Mr. Clanton and  they agreed to some modifications that will be reflected in the complaint filed for jury trial.  Those modifications include dates.

Franco is charged with five counts of PC 288.7 (b),oral copulation or sexual penetration  with a child 10 years or younger and four counts of PC 288 (a), Lewd Act Upon A Child. Alleged victim Jane Doe.

Special allegation of prior sex offense for Counts 6 to 9 jurisdiction Los Angeles (Norwalk).



Franco already has a prior conviction for lewd and lascivious act with a minor.
