Jurors still being interviewed in the Jon Goldberg case, this morning one of the jurors who gave a declaration



On October 19, Visiting Judge Graham Cribbs said he would rule on the defense motion for a new trial. The defense has alleged juror misconduct.

Judge Cribbs was also expected to rule on the defense motion to dismiss the special allegation of "personally and intentionally discharging a firearm" and great bodily injury to Tim Smith; that special allegation carries a sentence of 25 to life.

Judge Cribbs just said proceedings are going on.

Juror #9 who has been subpoenaed was waiting in the hallway and just went in at 8:44 a.m. He just left at 9:17 p.m.

Goldberg is now clean shaven.

Tim Smith's brother and wife were in the courtroom but after they spoke with Deputy District Attorneys Luke Bernthal and Trent Timm, they left.

Two other family members from Tim Smith's family just showed up. They had no idea that the courtroom would be closed either.

Once again, no information was provided about when the ruling will occur except that proccedings are still going on in a closed courtroom.

Since there are no minutes and since the same events keep being listed, better to show up, just in case.

In Count 1, Goldberg was charged with First degree murder. The jury did not find Goldberg guilty of First Degree murder. The jury found Goldberg guilty of a lesser charge of Second degree murder; that sentence is 15 years to life.

Goldberg was found not guilty of Counts 2 and 3.
