David Ervin Gunderson guilty on all counts


Another jury in Courtroom 2 also came back with a guilty verdict. This jury found David Ervin Gunderson guilty on all counts. Victim was John Doe.


Case was prosecuted by Deputy District Attorney Steven Steward. Gunderson was represented by Mr. Ken Bareilles.

Sentencing is on March 5.

Yesterday, a jury found 62-year-old David Ervin Gunderson guilty of driving under the influence causing injury.  The jury also found true the special allegations that the defendants blood alcohol concentration was over .15% and that he inflicted great bodily injury on a juvenile victim.  

The charges resulted from an incident on September 30, 2017 on Central Avenue in McKinleyville. Mr. Gunderson was driving with a blood alcohol level nearly three times the legal limit when he struck a juvenile on a bicycle, causing serious injuries. 

 Deputy District Attorney Steven Steward prosecuted the case with assistance from District Attorney Investigator Adam Jager. 

The juvenile victim, California Highway Patrol Officer Phil Price, California Department of Justice Criminalist Dale Cloutier, Dr. Lois Cook, and an eyewitness testified at trial.  The District Attorney’s Office appreciates the contributions of the witnesses and jury to justice in this case.  Sentencing is scheduled for March 5th, 2018 at 8:30 am; Mr. Gunderson faces a maximum possible sentence of 7 years in state prison.
