Trial setting and 995 motion for Sean Allman continued to end of July

Sean Allman's case was scheduled for trial setting and defense motion to dismiss on July 8.

His attorney, Mr. Ben Okin, told me that he was gping to request the date be continued for a couple weeks and it was to July 29.

Kathleen McNight arrested on assault and domestic violence charges

Kathleen Elizabeth McKnight was arrested yesterday by the Eureka Police Department for PC245(a)(1) assault with a deadly weapon and PC273.5(a) corporal injury to spouse/cohabitant.

Domestic violence and DUIs are frequent charges in daily Humboldt arrests. The drug busts make headlines but if you pay attention to the daily jail log, the arrests for illegal firearms, violence and booze are a constant.

Former Humboldt County Correctional Deputy and convicted molestor Cory Fisher had filed an appeal.

Since this post was published, on July 12, there was an update. Fisher's petition for rehearing was denied.

Deputies arrest inmate who tried to escape from court

On July 6, 2021, at about 2:12 p.m., a Humboldt County Correctional Facility inmate attending a scheduled court hearing inside a courtroom of the Humboldt County Superior Court attempted to escape from custody.

Murder suspect Daniella Moore's preliminary hearing resumed this morning. This is Day 3 of the preliminary hearing. Eureka Police Department Senior Detective Ron Harpham is testifying.

I had no idea DHHS would be mentioned in today's testimony. In previous coverage, I mentioned that I worked at CWS with Hannah Hayhurst's mother.

Anthony David Maillelle was arrested yesterday by HCSO on a bench warrant issued for PC242 and PC 240. He was arrested in May 2021.

Starbucks on 5th to resume regular lobby hours

 

They have redone the seating area. At 5 a.m. there are only a couple of options but Starbucks offers drive thru, takeout and seating options.

Masks for employees, if you are vaccinated, are no longer required as of July 5. In two weeks, the lobby will be back to being open at 5. a.m. In Old Town, it is the only quick option open at that time for people working, walking and traveling.

First movement from Watson jury in a day and half

 

The Brandon Watson jury started deliberations a few minutes after 4 p.m. on June 29.

They came back on June 30 and started deliberations at 10 a.m. There were no notes from the jury. They deliberated until 4:30 p.m.

On July 1, they started around 10 a.m. and left for lunch. Started deliberations shortly after 1 p.m.

At 1:48 p.m., the bailiff was called to the jury room. At 1:51, the bailiff handed a note to the Judge. At 1:55, the bailiff went back to the jury room.

I don't think people realize how stressful the work environment is every day in courts which has only worsened with the impact of COVID 19 closures and restrictions, the ever existing court backlog and conditions that change at a whim. Appreciate your attorneys and court staff because surviving Humboldt Superior Court is  multi tasking at Olympic level.

Mauricio Johnson makes an offer to resolve case the day of his preliminary hearing

 

Preliminary hearing for Bear River homicide suspect Mauricio Johnson was scheduled for July 1. At the last hearing, it was indicated time estimate and date could change. It is now 1 or 2 days.

Ms. Andrea Sullivan is Johnson's attorney. Deputy District Attorney Roger Rees is the prosecutor for the case.

There was a surprise twist this morning. 

Confusion in court about past hearings and dates

 

Murder suspect Ryan Tanner was scheduled as change of plea on July 1 in the system. That was incorrect or was it? The August 4 date was not known or listed  from the previous minutes so I have no idea why Judge Kaleb Cockrum and the court clerk did not know. I was in court when the August 4 date was scheduled.

Motion to dismiss, motion to continue in Sean Allman case

 

Sean Allman's jury trial scheduled for July 19 was confirmed at the last hearing. On July 1, there was a hearing on the defense motion to continue. People had no opposition to the motion to continue. It was granted for good cause by Judge Lawrence Killoran. Reason was not stated on record but hinted at in remarks by defense.

There is also a defense motion to dismiss. The People filed an opposition to the motion to dismiss.
