Justin Sylvia arrested by HCSO for threats against public officials, elder abuse, resisting arrest and probation violation

 

26 year old Justin Case Sylvia was arrested by HCSO early a.m. yesterday for PC 71 threats against public officials or public employees or school officials, PC 148 (a) (1) resisting arrest, PC 368 (b)(1) elder or dependent abuse and PC 1203.2(a)(2) probation violation.

He has a previous arrest and cases from 2018 to 2025. I checked on the 2024 case was dismissed.

He has two 2025 cases. Sylvia was arrested on 6/1. The DA filed a complaint on 6/4. Sylvia was arraigned in CR2501146. OR bail on 6/6; trial confirmation on 6/26 and jury trial on 6/30. The DA charged Sylvia with three misdemeanors  Count 1 PC 368 (c) elder or dependent adult abuse. Count 2 and 3 are PC 148 (a) 1 resisting or obstructing a public or peace officer. Alleged victim in Count 2 is Cole Kane. Alleged victims in Count 3 are Russell Hurley and Shirley Yanez.

Count 1 is the same alleged victim as the previous 2025 case filed in January 2025. Court minutes say Public Defender.

The other 2025 case CR2500305 was filed on 1/30/25. The charge is PC 242 battery. Alleged victim is Hiyou McCovey Chuffy Sylvia. In that case Justin Sylvia was arraigned on 5/19;  Court minutes say Conflict Counsel appointed; trial confirmation on 8/12 and jury trial on 8/18.

6/6/25: The OR bail in CR2501146 was continued to 6/9, Public Defender  & Conflict Counsel both have conflicts and Gregory Kreis was cced. He is one of the private attorneys on the Conflict panel.

6/9/25: Kreis appointed. On 6/10 supervised release granted. Trial confirmation on 6/26; jury trial on 6/30/25.

6/26/25: Trial confirmation scheduled for today and jury trial for 6/30/25 vacated. Trial confirmation rescheduled for 8/12 ; jury trial for 8/18. CR2500305 same dates.

8/12/25: Failed to appear; bench warrant for $15,000 issued by Retired Judge Christopher Wilson, supervised release terminated. 8/18 date vacated.
