Attempted murder, mayhem, torture and assault with a deadly weapon suspect Luigi Messina jury deliberated for less than 24 hours. They started deliberations at 2:22 p.m. Left at 4:16 p.m. on Friday. They were here for a few hours today.
Judge Steven Steward is presiding over the trial. Deputy District Attorney Carolyn Schaffer is the prosecutor for this case. Ms. Andrea Sullivan is Messina's court appointed attorney. Messina has had other attorneys prior to Ms. Sullivan. DA Investigator Martin Morris assisted with the case.
Jurors have been asked to return tomorrow morning at 10:15. Sometime tomorrow morning, after the 8:30 calendar has concluded and if Messina does not pull any last minute stunts, court proceedings may actually proceed on time.
Messina was found not guilty of torture and attempted murder. Found guilty lesser attempted charge of voluntary manslaughter, mayhem and assault with a deadly weapon and special allegations found true. there will be arguments on circumstances in aggravation.
Ms. Sullivan had asked Judge Steward for a directed verdict on the torture charge. It was denied. Besides that win from the jury, the real kudos goes to Ms. Sullivan because torture is a life charge. Messina not being found of a guilty of attempted murder is also a win for Ms. Sullivan because attempted murder can be a life sentence vs voluntary manslaughter which can range from the lower term 3 to maximum term 11 years. Considering Messina botched his testimony, Ms. Sullivan saved him with her cross examination and closing arguments.
Ms. Schaffer got a conviction on three counts even though the voluntary manslaughter is a lesser charge and all special allegations were found true.
