Only in Humboldt can you assault a local attorney who is a former marine, break his ribs and have your domestic violence case dismissed in a plea deal for possible drug court and probation

Steven Miller is the suspect who assaulted local attorney Delman Smith. Miller had preliminary hearings scheduled on 6/12 in CR2500891 and CR2500892.

CR2500891 was dismissed after Miller entered a plea in CR2500892. Miller pleaded guilty to assault likely to produce great bodily injury and the special allegation; the elder abuse charge was dismissed. Sentencing on 7/10.

Deputy District Attorney Brandon Boozari is the prosecutor. Deputy Public Defender Casey Russo is Miller's attorney. Defense requested a drug court evaluation by Probation.

7/10/25: Judge Steven Steward granted Deputy Public Defender Casey Russo's motion to continue sentencing which is now scheduled for 7/30. Deputy DA Brandon Boozari did not object to the continuance. Mr. Delman Smith's wife was present on Zoom.

7/30/25: Judge Steven Steward sentenced Miller to three years in prison with 220 custody credits. There is a hearing on 8/1 for clarification of sentence.
